Acceptance of Terms
By engaging the services of Boss 406 (hereinafter "the Company"), you agree to be bound by these Terms and Conditions. These terms govern all transactions related to the sale, installation, and service of equipment provided by the Company, including but not limited to automatic lubrication systems, fluid dispensing systems, fire suppression systems, and air compressors.
Equipment Sales
Orders: All equipment orders are subject to acceptance by the Company. Prices are subject to change without notice.
Delivery: The Company will make reasonable efforts to meet estimated delivery timelines, but is not liable for delays beyond its control.
Acceptance: Upon delivery, the customer is responsible for inspecting the equipment for damage. Acceptance of the equipment constitutes acknowledgment of its satisfactory condition.
Installation and Service
On-Site Service: The Company provides on-site installation and service of equipment at the customer's location.
Access: The customer is responsible for providing safe and adequate access to the equipment for installation and service.
Scheduling: Installation and service appointments are scheduled based on availability and may be subject to change.
Abandoned Equipment: If the Company performs repair work on a customer's equipment, the customer has 30 days from the completion of the repair to pick up the equipment. Failure to do so will result in the equipment being considered abandoned, and the Company may dispose of it without further notice to the customer.
Warranty
Coverage: The Company warrants that all products sold will be free from defects in materials and workmanship for a period of 1 year from the date of purchase. This warranty does not cover damage caused by misuse, neglect, improper installation, or normal wear and tear. Warranty coverage on products from third-party vendors, including Graco, Sulivan, and Fuel Cloud, are subject to their own individual terms and conditions.
Claims: Warranty claims must be submitted in writing to the Company, along with proof of purchase.
Remedies: The Company's sole liability under this warranty is limited to repair or replacement of the defective equipment.
Restocking Fees
Unused Equipment: A 15% restocking fee will be applied to any unused equipment returned within 30 days of purchase. The equipment must be in its original packaging and condition. Shipping costs are non-refundable.
Special Orders: Restocking fees may be higher for special order items or equipment that has been modified or customized. Customers have 30 days to take delivery of special order items. Failure to claim ordered parts within this timeframe will result in forfeiture of the parts and any deposit made for the order.
Limitation of Liability
Indirect Damages: The Company shall not be liable for any indirect, incidental, special, or consequential damages arising out of the sale, installation, or service of equipment, even if the Company has been advised of the possibility of such damages.
Direct Damages: The Company's liability for direct damages shall be limited to the purchase price of the equipment or services provided.
Indemnification
The customer agrees to indemnify and hold the Company harmless from any and all claims, losses, damages, liabilities, costs, and expenses (including attorney's fees) arising out of the customer's use of the equipment or services provided by the Company.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Montana.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the Company and the customer with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
